This tool cannot and does not determine whether your business is insolvent. The legal test of insolvency — whether a company can pay its debts as and when they fall due — is a question of fact that depends on your full circumstances and requires professional assessment.
About these warning signs
The twelve items above are adapted from the indicators of insolvency that Australian courts have considered in insolvent trading cases and that ASIC describes in its guidance for directors on insolvency (see asic.gov.au). They include continuing losses, overdue Commonwealth and State taxes, poor access to finance, suppliers insisting on cash on delivery, special arrangements with creditors, dishonoured payments, legal action by creditors, and the inability to produce timely financial information.
No checklist replaces professional judgement. If several of these signs are present, the most valuable thing you can do is act early: directors who seek advice promptly have more options — including, in some cases, restructuring or the safe harbour protections — than those who wait. Read our guides on director liabilities and the formal insolvency processes for more background.
